Understanding SAE & Buyback Program Obligations
Buyback Program: This is a protective deed restriction that grants HHFDC the “first option” to repurchase your home if you sell or transfer the title within the first 10 years of ownership. It ensures the property remains owner-occupied and affordable during this initial control period. This restriction automatically expires 10 years after your deed is recorded.
Shared Appreciation Equity (SAE): This program requires homeowners to share a fixed percentage of their home’s net appreciation with the State of Hawaiʻi when the property is sold, transferred, or rented. Unlike the Buyback program, the SAE restriction does not expire and remains tied to the property title until the State’s share is paid in full.
